1. Who you are contracting with

These Terms & Conditions ("Terms") are entered into between you and David Jewel Jeremiah Daniel Hanson, trading as David Developers ("we", "us", "our"). They govern your use of our websites, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you confirm you have the authority to bind that organisation.

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose).

7. Payments and subscriptions

Payments are processed securely by a third-party payment provider on our behalf. Subscriptions renew automatically at the chosen billing frequency until cancelled. Fees are exclusive of taxes unless stated otherwise; applicable taxes may be collected at checkout.

8. Refunds

Refunds are handled in line with our Refund Policy.

9. User content

You retain ownership of any content you submit. You grant us a limited, worldwide licence to host, store, and process that content solely as needed to provide the Service.

10. Suspension and termination

We may suspend or terminate your access to the Service if:

• You materially breach these Terms;
• Payment fails or is overdue;
• We reasonably suspect fraud or a security risk;
• You repeatedly or seriously violate our acceptable use rules.

You may stop using the Service at any time.

11. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or loss of goodwill. Nothing in these Terms limits liability that cannot lawfully be limited (e.g. fraud, death, or personal injury caused by negligence).

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your user content, your unlawful use of the Service, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which David Jewel Jeremiah Daniel Hanson is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory law provides otherwise.
